The breakdown of a marriage is usually one of the most difficult and painful experiences in a person's life. In addition to the often highly emotional aspects
of separation and divorce, there are many important legal and financial
issues to consider.
At Johnson and Pauls, S.C., we respect the sensitive and difficult circumstances that bring you to us in matters of marriage dissolution. We will take the time to listen to you and provide an objective assessment of your situation, and provide you with legal advice based on our expertise representing clients under Wisconsin divorce laws. We will then work with you to assure that all of your legal interests are fully protected.
We schedule initial consultations for a small fee. At that time, we will evaluate your case and discuss your goals and expectations.

Legal custody
Legal custody refers to the right of a parent to make decisions regarding non-emergency medical procedures, education, religion and other welfare issues. Unless there is good reason to deny one parent these rights, Wisconsin law assumes that custody will be jointly held.
Physical Placement
Physical placement is the right of a parent to have a child physically placed with that parent. Physical placement is often referred to as physical custody or legal placement. It is sometimes referred to with terms such as placement and visitation. However, visitation is completely different.
Child Visitation for Non-Parent
Child visitation refers to the time that a child spends with a person (i.e. to visit). A person who enjoys visitation rights with a child has no legal decision making power over that child nor the right to primary physical placement of that child. People who are awarded visitation are those who have had close connections and ties with the child, perhaps acted as a parent, or are related in some manner such as a grandparent.
Custody orders
When divorcing spouses with children conclude their divorce proceedings, a Wisconsin Circuit Court will enter a final judgment of divorce (a divorce decree) which will include the court's orders for the legal custody and physical placement of the spouses' child or children.

Mediation is an alternative dispute resolution process. A mediator is an impartial third party who helps people resolve disputes. Through mediation, the parties resolve their dispute (or disputes) forming an agreement. During the process, the mediator facilitates communications, provides legal guidance, and helps the parties focus on the matters at hand. When the parties form their agreement, the mediation process is over. The mediator sets that agreement to written form. Wisconsin law requires mediation in all cases where custody and placement is in dispute.
